A collection effort may not result in a cash payment with this type of debt collection.
  2. Unsecured assets in a bank account can be used as collection cash. Some debt collectors attempt to place a lien on an individuals bank account in an effort to collect on a cash judgment.
  3. An individuals tax refund has been used as an account to garnish. Collecting on a judgment by garnishing a persons tax refund can be attempted. The individuals wages are tied up with a tax refund and can be used as a lien source.

Collecting with Wage Garnishments

Using an individuals taxes as a source of cash collection can end up as a wage garnishment with the persons employer. This type of lien is placed against the future income of the worker in an attempt to collect on a cash judgment. There are certain requirements that are needed in order to successfully win a wage garnishment.

Collecting from Taxes

Collection efforts against an individuals taxes may take a second seat to other collection or legal efforts. A person who has filed for bankruptcy is not usually available for a tax lien. The persons estate is being managed by a local court trustee, and other lien attachments may not be approved.
